Terms and Conditions of the “Christmas Market Tester” Competition

Civitatis are sending one lucky applicant to test the Christmas markets of Europe
, to report back and inform the Civitatis team and to provide great social media content. Below are the terms and conditions for the contest – if you’re thinking of applying, do so on the jobs page by uploading a paragraph on what you love most about Christmas markets, along with two christmas photos with accompanying captions. TERMS AND CONDITIONS OF THE “CHRISTMAS MARKET TESTER” COMPETITION
One. –COMPETITION PROMOTER, PRIZE, PROMOTIONAL PERIOD AND CONDITIONS
This competition is organised by Civitatis Tours S.L. (henceforth, “CIVITATIS”), with registered business address at Calle Coloreros 2, 28013, Madrid, Spain, and N.I.F [tax identification number] B- 86899440.
The “Christmas Market Tester” prize draw (henceforth, the “Competition”) will be held by CIVITATIS in Spain. It will be undertaken via the Internet and is open to participants over 18 years of age, regardless of nationality. If required, the successful applicant may be asked to provide proof of age.
The Competition will begin on the 18th of November 2019 and end on the 30th of November 2019, however CIVITATIS reserves the right to modify the dates of the Competition.
Two. –ELIGIBILITY TO PARTICIPATE
The Competition is open to all people (henceforth, “Participants”) who accept these Terms and Conditions and who fulfil all of the following participation requirements:
- Must be over 18 years old.
- Must be available to travel between Prague and Budapest between the 16th and 19th of December 2019.
- Must have completed the online application form in full. This consists of uploading a C.V. and a cover letter featuring two Christmas photos and accompanying ‘Instagram captions’ as well as a corresponding blog post.
By entering this competition, the Participant accepts and agrees to abide by the present conditions.
Three. – PRIZES, COMPETITION AND REDEMPTION CONDITIONS
One (1) winner will be selected from a draw of the Participants who have applied via the entry form. The successful applicant will be decided internally by Civitatis, based on
Participants who do not fulfil every requirement will be automatically excluded from the Competition prize draw. Any application deemed fake or to have committed fraud will also be excluded from the Competition prize draw.
Once the winner is selected, CIVITATIS undertakes to inform the winning applicant within one day of the closing date, informing said winner by email.
The prize of this Competition is four days visiting the Christmas markets of Europe. Specifically, this prize includes:
-Accommodation in Prague, Vienna, Bratislava and Budapest.
-Two transfers between cities by train, and one by bus.
– A cash prize of €200 (€50 per day)
The conditions of the prize are as follows: (i) the dates may not be modified (ii) the prize consists of travel and accommodation between 16 December 2019 and 19 December 2019 (iii) the prize does not include the cost of flights, food, tips, excursions, travel insurance or any additional costs not explicitly described, (v) the winning participant commits to curating one Instagram post per day for the duration of the trip, as well as a blog post afterwards. (vi) the prize is non-transferable and may not be exchanged for a cash equivalent. (vii) the competition winner is not an official employee of Civitatis, and as such Civitatis is not obliged to pay social security (viii) The prize money offered to the winning applicant is processed as a marketing cost, not as an employee salary.
If the winner cannot be located or contacted during the three (3) calendar days following the date of publication of the winner by CIVITATIS, the prize will be awarded to the first reserve winner who fulfils all participation requirements, and it will be understood that the original winner irrevocably renounces their right to the prize. In the case that none of the reserve winners can be located or contacted within the three (3) calendar day timeframe of notification, CIVITATIS reserves the right to withdraw the prize.
The winner will be responsible for any tax charges that the acceptance of the prize may imply, as well as any other expense derived from the Competition that is not expressly assumed by CIVITATIS in these Terms and Conditions.
Four. – LIMITATIONS
The following people and their immediate families (spouse, parent, child, sibling, grandparent and/or “step” family) are not eligible to participate in the Competition: (i) employees of CIVITATIS, associated agents and anyone professionally or legally connected with CIVITATIS, (ii) natural and legal persons who have a direct or indirect holding in the share capital of CIVITATIS, (iii) the Notary designated for the notarisation of these Terms and Conditions, or any employees of said Notary and (iv) natural and legal persons who have directly or indirectly participated or been involved in the creation or administration of the Competition (agencies, providers, etc.).
In accepting these Terms and Conditions, Participants consent to CIVITATIS excluding and disqualifying these parties from the Competition.
Any participation completed after the end date of the Competition will be considered null and void, as will those which do not fulfil the participation requirements established in Section Two of these Terms and Conditions. CIVITATIS reserves the right to exclude from the Competition any Participant who they suspect or prove to have participated fraudulently.
If it is found that the winners or reserve winners do not fulfil the requirements expressed in the Terms and Conditions, or that they have not fulfilled what is asked of them, their participation will be considered null and void and they will be automatically excluded from the Competition, forfeiting all right to the Competition prize.
The winner may not request any modification, alteration or compensation of the prize, nor may it be exchanged for any other product or cash equivalent. CIVITATIS reserves the right, with just cause and previous notice, to modify, suspend or extend this Competition.
There will be a timeframe of seven (7) calendar days following the date of publication of the prize winner during which disputes regarding this Competition may be made. Once this period of seven (7) calendar days has passed, the process to execute and/or organise the prize will commence.
Participants are hereby informed that they are not required to pay any additional cost to CIVITATIS as a result of this Competition.
CIVITATIS reserves the right, if necessary, to substitute the prize for another similar product.

Five. – LIABILITY DISCLAIMER.
CIVITATIS shall not be held liable for circumstances including but not limited to:
- The use that the winner makes of the Competition prize.
- Harm or damage of any nature that may be caused by the temporary lack or continuity of the working of telecommunication networks.
- The services provided by any other entity with which CIVITATIS collaborates when providing services to the winner, in fulfilment of the prizes given, as well as the consequences of any negligent conduct in the provision of said services.
- Any case of force majeure or unforeseen circumstance that may prevent the undertaking of the Competition or the complete or partial enjoyment of the prize. CIVITATIS reserves the right to cancel, modify or suspend the Competition should it not be undertaken, either due to fraud being detected, technical errors or any other reason outside of the control of CIVITATIS that affects the normal development of the Competition.
Six – PERSONAL DATA PROTECTION
CIVITATIS takes privacy and data protection very seriously. Therefore, any personal information gathered from Participants shall be kept securely and processed with the utmost care.
Pursuant to that established in REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND COUNCIL OF 27 APRIL 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (henceforth, “GDPR”) and in Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights (henceforth, “LOPDGDD”), when accepting these Terms and Conditions each Participant consents for the personal data provided when participating in this Competition to be incorporated into a database owned by CIVITATIS for the purposes of processing the Participant’s participation and, if appropriate, to inform them that they have won.
CIVITATIS maintains the appropriate security pursuant to the GDPR and the LOPDGDD and it has established all the technical measures within its capabilities to prevent the loss, misuse, alteration, non-authorised access and theft of the data that Participants provide through the Competition, notwithstanding Participants are hereby informed that online security measures are not indefeasible. CIVITATIS undertakes to fulfil its obligation to protect the privacy of the personal data contained in the automated file pursuant to the applicable legislation, as well as ensuring the secure processing should any data be subject to being transferred.
Participants guarantee that the personal data provided is true and they are responsible for informing CIVITATIS of any modification of said data. Participants, in any case, will be held responsible for the veracity of the data provided, with CIVITATIS reserving the right to exclude any Participant from the Competition if they have provided false data, notwithstanding any other actions applicable under Law. It is recommendable for the utmost diligence to be taken with regard to Data Protection by means of the use of security tools, with CIVITATIS accepting no liability for the theft, unauthorized changes to or loss of unlawful data.
Participants are hereby informed that they can exercise their rights to Access, Rectify, Delete, Oppose, Limit, Transfer or Remove their data and to not be subject to individual automated decisions, by means of sending an email to dpo@civitatis.com or by sending a letter addressed to Calle Coloreros 2, 28013, Madrid, Spain, with a copy of their DNI [Spanish National Identification Document] or passport attached.

Seven – CHANGES AND ACCEPTANCE
CIVITATIS reserves the right to modify or expand the Terms and Conditions of this Competition provided that this does not harm or infringe the rights of the Participants of the Competition.
Participation in this Competition implies the full acceptance of these Terms and Conditions, which may be recorded by a Notary and will be available to any person who wishes to consult them.
Eight. – APPLICABLE LEGISLATION AND JURISDICTION
These Terms and Conditions shall be interpreted and governed pursuant to Spanish law. Any disputes or controversy that may arise regarding the validity, interpretation or fulfilment of these Terms and Conditions will be subject to the jurisdiction of the Courts and Tribunals in the Participants’ city of residence.
